We, the organizations, academics, and citizens who sign this document, direct it to public opinion, the President of the Senate, and the Presidency in order to present our analysis of the quorum and the absolute majority of the November 30th session in the Senate, which approved the Legislative Act 017 Chamber, 05 Senate of 2017 (hereinafter, PAL 017-05 \/ 2017), which creates the special circumscriptions of peace.<\/p>\n

En estos d\u00edas se ha planteado un debate sobre la aprobaci\u00f3n en el Senado de la Rep\u00fablica del PAL 017-05\/2017). La pregunta es si la votaci\u00f3n cumpli\u00f3 con el qu\u00f3rum para decidir y obtuvo la mayor\u00eda absoluta que es requerida para este tipo de casos. Dos respuestas se han dado. De un lado, se ha dicho que el PAL 017-05\/2017 fue rechazado, pues tanto el qu\u00f3rum para decidir como la mayor\u00eda absoluta del Senado debe calcularse sobre las 102 curules que constitucionalmente integran esta corporaci\u00f3n. De otro lado, se ha se\u00f1alado que el PAL fue aprobado, ya que el qu\u00f3rum para decidir y la mayor\u00eda absoluta del Senado debe contarse sobre 99 curules, pues 3 senadores tienen falta temporal debido a investigaciones penales en su contra y no pueden ser reemplazados, por lo que sus curules deben ser descontadas del total para determinar el qu\u00f3rum y las mayor\u00edas en las decisiones.<\/p>\n
