“There is no control over deforestation” … “Deforestation in the Amazon directly affects global warming” … “The depredation of vegetative species puts at risk and violates fundamental rights such as water, food security, health, human dignity, and a healthy environment.” These are some of the arguments used by the Inspector General’s Office in an amicus filed before the Superior Tribunal of Bogot\u00e1 to support the legal action that 25 children and young people filed on Monday, January 29 in the same court. The lawsuit argues that deforestation in the the Amazon and its effects on the warming of the country are threatening their rights to life, health, food and water.<\/span><\/p>\n

El procurador delegado para Asuntos Ambientales, Gilberto Augusto Blanco Z\u00fa\u00f1iga, expres\u00f3 su apoyo a los ni\u00f1os y j\u00f3venes, y solicit\u00f3 que se le ordene al Estado colombiano tomar medidas contundentes para frenar la deforestaci\u00f3n en la regi\u00f3n m\u00e1s biodiversa del pa\u00eds. \u201cLe asiste raz\u00f3n a los demandantes al indicar que los graves efectos de la deforestaci\u00f3n en la Amazon\u00eda colombiana les est\u00e1 generando afectaciones a nivel de derechos fundamentales, materializadas en el hecho de sufrir las consecuencias del desabastecimiento de agua, de alimentos, riesgos asociados a las amenazas de la naturaleza; pero sobre todo, la imposibilidad de gozar de un ambiente sano que les garantice condiciones dignas de existencia en el presente y en el futuro, dado el efecto irreversible del calentamiento global\u201d, se\u00f1ala el procurador Blanco Z\u00fa\u00f1iga en el documento.<\/span><\/p>\n

Tambi\u00e9n, asegura que los derechos fundamentales que est\u00e1n invocando los j\u00f3venes \u201chan sido gravemente vulnerados\u201d por la Presidencia, los ministerios de Ambiente y Agricultura, Parques Nacionales; y las alcald\u00edas, gobernaciones y corporaciones aut\u00f3nomas de la Amazon\u00eda, que son las entidades demandadas en esta tutela apoyada por Dejusticia. Seg\u00fan la Procuradur\u00eda estas entidades han faltado a sus \u201cfunciones constitucionales y legales\u201d de frenar la tala de bosque amaz\u00f3nico, que fue un compromiso ratificado por el Gobierno colombiano en la Cumbre de Cambio Clim\u00e1tico de Par\u00eds del 2015. Adem\u00e1s asegura que en el pa\u00eds no existe \u201cuna pol\u00edtica clara de gobernanza forestal que conduzca a un manejo racional y sostenible de los bosques y de sus reservas forestales\u201d.<\/span><\/p>\n

Una de sus principales conclusiones es que \u201cla deforestaci\u00f3n indiscriminada, es un gran problema para la sociedad actual y para las generaciones futuras\u201d. Explica que esta actividad es responsable de la emisi\u00f3n de los gases causantes del cambio clim\u00e1tico (el mismo argumento que los j\u00f3venes reiteran en su demanda), y que adem\u00e1s genera la p\u00e9rdida de animales y especies, altera el ciclo del agua y genera erosi\u00f3n. \u201cTodos estos efectos provocan el aumento de las inundaciones en \u00e9poca de invierno, la falta de agua en \u00e9poca de verano, y la restricci\u00f3n para producir alimentos\u201d.<\/span><\/p>\n

Por \u00faltimo, el procurador Gilberto Augusto Blanco pide que se amparen <\/span>los derechos fundamentales de los ni\u00f1os y j\u00f3venes demandantes a la dignidad humana, la salud, la alimentaci\u00f3n, el agua y el medio ambiente sano; derechos que est\u00e1n \u201camenazados por las entidades p\u00fablicas demandadas en raz\u00f3n a omisiones derivados de incumplimientos de sus deberes de protecci\u00f3n, conservaci\u00f3n, inspecci\u00f3n y control sobre los bosques nativos de la Amazon\u00eda Colombiana\u201d.<\/span><\/p>\n

Adem\u00e1s el ente de control pide que se reconozca la Amazon\u00eda Colombiana como <\/span>una \u201centidad sujeta de derechos<\/span> a la protecci\u00f3n, conservaci\u00f3n, mantenimiento y restauraci\u00f3n a cargo del Estado, las comunidades \u00e9tnicas y de los residentes en su zona de influencia\u201d, as\u00ed como ocurri\u00f3 el a\u00f1o pasado con una tutela que ped\u00eda proteger al r\u00edo Atrato de la miner\u00eda; solicita que se le ordene al Ministerio de Ambiente formular una pol\u00edtica de gobernanza forestal en un plazo de seis meses, y que las autoridades ambientales, gobernaciones y alcald\u00edas contrarresten toda forma de deforestaci\u00f3n<\/span> en esa \u00e1rea.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
