The Criminal Chamber of the Court emphasizes that the State needs statistical information on agricultural workers because this is the only way to take them into account in the creation of public policies that guarantee their right to material equality. In other words, so that they can enjoy all their rights in similar conditions to the rest of the population.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">La Corte Suprema le orden\u00f3 al DANE, a los ministerios del Interior y de Agricultura, a la Presidencia y al Instituto Colombiano de Antropolog\u00eda e Historia (ICANH), que elaboren unos \u201cestudios complementarios al Censo Agropecuario 2014 y al Censo Poblacional 2018\u201d para precisar el concepto de \u201ccampesino\u201d y contabilizar a este grupo. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Adem\u00e1s, le orden\u00f3 al Grupo de Asuntos Campesinos del Ministerio del Interior, que fue creado el pasado noviembre por insistencia de las organizaciones campesinas, que \u201cidentifique la situaci\u00f3n actual de la poblaci\u00f3n campesina\u201d y \u201capoye la formulaci\u00f3n y seguimiento de planes, programas y pol\u00edticas p\u00fablicas\u201d que garanticen el derecho de estas personas a la igualdad material.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Esta decisi\u00f3n coincide con las alternativas que el campesinado le present\u00f3 a la Corte, teniendo en cuenta que el Censo Poblacional hab\u00eda comenzado a realizarse de manera virtual en enero sin las preguntas sobre la vida campesina. Las opciones que plantearon buscaban proteger sus derechos fundamentales y, al mismo tiempo, no generar graves traumatismos administrativos ni financieros frente a una eventual suspensi\u00f3n o reinicio del censo.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La primera petici\u00f3n era que se le ordenara al DANE y al Ministerio del Interior aplicar un formulario espec\u00edfico sobre la \u201ccategor\u00eda campesinado\u201d, que se diligenciar\u00eda al mismo tiempo que el censo poblacional, en la etapa puerta a puerta. La segunda alternativa era que se le ordenara a estas mismas entidades que, en el plazo de un a\u00f1o, elaboraran un estudio estad\u00edstico complementario al censo poblacional. El objetivo de ambas alternativas era indagar tanto por sus condiciones sociales, econ\u00f3micas y demogr\u00e1ficas, como por su identidad cultural.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Estas peticiones alternas no significaban que el campesinado hubiese renunciado a la solicitud que ha hecho durante a\u00f1os al Estado de recaudar informaci\u00f3n estad\u00edstica sobre ellos. Por el contrario, las organizaciones aseguraban que las alternativas eran afines al equilibrio presupuestal de la Naci\u00f3n y a la satisfacci\u00f3n progresiva de sus derechos. <\/span><\/p>\n<p>En el mismo sentido de la decisi\u00f3n de la Corte Suprema de Justicia, la Procuradur\u00eda Delegada para Asuntos Agrarios y Restituci\u00f3n de Tierras ha convocado un espacio de di\u00e1logo entre los ministros del Interior y de Agricultura, el DANE, el ICANH, la academia, representantes de las organizaciones campesinas y Dejusticia como abogados de estas \u00faltimas.
