The title of the cartoon, &#8220;Duque, reflects,&#8221; reveals that the pig in the image represents the presidential candidate Iv\u00e1n Duque, who is supported by the right-wing party Democratic Center (currently led by former president Alvaro Uribe).<\/p>\n<p>&nbsp;<\/p>\n<p>\u201cSoy el \u00fanico Uribista que no est\u00e1 \u2018cochino\u2019\u201d, afirma un cerdo vestido de traje en una caricatura de Julio C\u00e9sar Gonz\u00e1lez Quiceno, conocido como \u2018Matador\u2019, publicada en el diario El Tiempo el domingo 25 de febrero. El t\u00edtulo de la caricatura, \u201cDuque, reflexiona\u201d, revela que el personaje de la imagen es el candidato presidencial por el Centro Democr\u00e1tico Iv\u00e1n Duque.<\/p>\n<p>Un partidario del Centro Democr\u00e1tico interpuso una tutela en contra del caricaturista y de la Casa Editorial El Tiempo, argumentando que esa imagen era una manifestaci\u00f3n denigrante contra los \u201curibistas\u201d. Adem\u00e1s, el \u201cseguidor del senador \u00c1lvaro Uribe V\u00e9lez\u201d, como el demandante se presenta en la tutela, se\u00f1al\u00f3 que si bien la libertad de expresi\u00f3n es un derecho fundamental no puede afectar los derechos fundamentales de otras personas.<\/p>\n<p>Dejusticia intervino en esta demanda a favor de la libertad de expresi\u00f3n de \u2018Matador\u2019 y la Casa Editorial El Tiempo. Argumentamos que existe una s\u00f3lida jurisprudencia de la Corte Constitucional y algunos tribunales internacionales, como la Corte Interamericana de Derechos Humanos, que protegen de manera especial las expresiones art\u00edsticas como las caricaturas, y los discursos sobre asuntos de inter\u00e9s p\u00fablico, como la cr\u00edtica a los pol\u00edticos y candidatos a cargos p\u00fablicos. Para la democracia es vital proteger los discursos pol\u00edticos porque promueven el control social y le hacen contrapeso a la censura, que hist\u00f3ricamente ha sido una herramienta usada por los gobiernos autoritarios.<\/p>\n<p>Adem\u00e1s de demostrar que la caricatura de \u2018Matador\u2019 est\u00e1 doblemente protegida por la Constituci\u00f3n Pol\u00edtica, concluimos que esta caricatura no vulneraba el derecho al buen nombre del ciudadano demandante. El derecho al buen nombre implica que se difunda informaci\u00f3n falsa sobre una persona. La caricatura de \u2018Matador\u2019 no pretend\u00eda difundir informaci\u00f3n sino manifestar una opini\u00f3n personal, y las opiniones nunca son verdaderas o falsas ni siquiera si se trata de opiniones chocantes y ofensivas, ya que la libertad de expresi\u00f3n en Colombia protege tambi\u00e9n este tipo de opiniones. Adem\u00e1s, la caricatura de \u2018Matador\u2019 se enmarca dentro de la s\u00e1tira pol\u00edtica que es por definici\u00f3n un discurso mordaz, agudo, exagerado y burlesco.
