In 2016, the NGO Educar Consumidores issued a commercial about the possible health effects of excessive sugary drinks consumption. The commercial was censored by the Superintendency of Industry and Commerce, just when a tax bill on these beverages was being debated in Congress, which was ultimately not approved. Educar Consumidores filed a lawsuit demanding the protection of their freedom of expression, while Dejusticia and other organizations that are part the Food Health Alliance filed another lawsuit to protect the right of consumers to access this type of information.<\/p>\n

La Corte Constitucional respondi\u00f3 a las dos tutelas en una misma sentencia (T-543 de 2017<\/a>) d\u00e1ndole la raz\u00f3n a los tutelantes. En el fallo le orden\u00f3 a la Superintendencia publicar el contenido de la sentencia en su p\u00e1gina web y le advirti\u00f3 que no pod\u00eda adoptar medidas que implicaran un control previo sobre la informaci\u00f3n, pues solo pod\u00eda adoptar resonponsabilidades ulteriores, en las que siempre se deb\u00eda respetar los derechos fundamentales de los implicados.<\/p>\n

Sin embargo la Superintendencia impugn\u00f3 el fallo argumentando que se estaba desconociendo la jurisprudencia existente en el tema, y que en este caso, los accionantes no deb\u00edan usar la tutela para la protecci\u00f3n de derechos colectivos.<\/p>\n

La Corte Constitucional neg\u00f3 la impugnaci\u00f3n y ratific\u00f3 el fallo inicial, argumentando que la Superintendencia no hab\u00eda logrado demostrar que el fallo \u201chubiera desconocido alg\u00fan pronunciamiento de la Sala Plena o la jurisprudencia en vigor de las salas de revisi\u00f3n\u201d y que tampoco se hab\u00eda demostrado que la sentencia desconociera el debido proceso. La Sala Plena de la Corte Constitucional concluy\u00f3 que \u201cpor el contrario, la solicitud se bas\u00f3 en interpretaciones jur\u00eddicas diferentes a las contenidas en la sentencia censurada, o estaban encaminados a reabrir debates pasados y controversias ya resueltas, demostrando su disgusto e inconformidad con la decisi\u00f3n adoptada por la Sala\u201d. El fallo fue ratificado por la Corte y el argumento se mantuvo intacto.<\/p>\n

Para Diana Guarnizo, investigadora de Dejusticia \u201cEl fallo ratifica lo que la Corte Suprema de Justicia y la Sala Novena de revisi\u00f3n de la Corte Constitucional ya hab\u00edan confirmado antes: que los consumidores tenemos derecho a saber el impacto que el consumo excesivo de ciertos productos tiene en nuestra salud y que los mensajes de salud p\u00fablica en este sentido no pueden ser censurados.
