Today, there is a case regarding the violation of the right of the Xinca indigenous community to free, prior and informed consultation and consent in Guatemala. During 2012 and 2013, the Ministry of Energy and Mines granted mining licenses to the Escobal mining company and to the Juan Bosco exploration project without consulting with the Xinka people. For that reason, the Xinka indigenous people opposed these projects and filed an action to protect their rights.<\/p>\n

Junto a \u00a0la Cl\u00ednica de Derechos Humanos de la Universidad de Ottawa, la Cl\u00ednica de Derechos Humanos de la Universidad de Columbia, Earth Rights International, la Fundaci\u00f3n para el Debido Proceso (DPLF por sus siglas en ingl\u00e9s), el Instituto de Democracia y Derechos Humanos de la Pontificia Universidad Cat\u00f3lica del Per\u00fa, la Plataforma Internacional contra la Impunidad, y el Robert F. Kennedy Human Rights , Dejusticia present\u00f3\u00a0\u00a0a la Corte de Constitucionalidad un amicus<\/em> en favor de los derechos del pueblo Xinka en Guatemala. El amicus<\/em> es el resultado del trabajo conjunto de estas organizaciones que buscaron presentarle a la Corte una serie de argumentos para que proteja los derechos de los pueblos ind\u00edgenas.<\/p>\n

En el amicus<\/em> presentamos argumentos para que la decisi\u00f3n de la Corte de Constitucionalidad incluya los avances y reconocimientos internacionales de los derechos de los pueblos ind\u00edgenas. Especialmente nos referimos al derecho al autoreconocimeinto de los pueblos ind\u00edgenas, el derecho a la consulta y el consentimiento y las garant\u00edas derivadas de los derechos especiales de participaci\u00f3n de los pueblos ind\u00edgenas.
