But if you slowly increase the temperature, it will stay until its too late. That\u2019s how civic space disappears: not with a sudden crackdown, but through a gradual development of legal pressure that erodes civic activity, until there is no room left.\u00a0<\/span><\/p>\n<h2><b>Orb\u00e1ns Authoritarian shift\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Since returning to power in 2010, Viktor Orb\u00e1n has systematically dismantled Hungary\u2019s democratic institutions. Backed by a constitutional supermajority his party \u2013 Fidesz \u2013 has amended the Constitution <\/span><a href=\"https:\/\/constitutionnet.org\/news\/voices\/15th-amendment-hungarian-fundamental-law-advancing-illiberal-christian-democracy?utm_\"><span style=\"font-weight: 400;\">fifteen times<\/span><\/a><span style=\"font-weight: 400;\">, and overhauled the country\u2019s legal order. Media outlets have been brought under state influence, education has been politicised, and the judiciary co-opted.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the most sustained targets is civic space. Orb\u00e1n\u2019s government has invoked transparency and national sovereignty to justify a series of laws designed to suffocate independent civil society.\u00a0<\/span><\/p>\n<h2><b>LexNGO and the Beginning of Legal Repression<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In 2017, Hungary passed the Law on the Transparency of Organisations Receiving Foreign Funds &#8211; <\/span><a href=\"https:\/\/helsinki.hu\/wp-content\/uploads\/LexNGO-adopted-text-unofficial-ENG-14June2017.pdf?utm_\"><span style=\"font-weight: 400;\">LexNGO 2017<\/span><\/a><span style=\"font-weight: 400;\"> \u2013\u00a0 marking the first of series of laws used to label independent groups as foreign agents. It required organisations receiving over<\/span><a href=\"https:\/\/www.venice.coe.int\/webforms\/documents\/default.aspx?pdffile=CDL-AD(2017)015-e&amp;utm_\"> <span style=\"font-weight: 400;\">HUF 7.2 million annually<\/span><\/a><span style=\"font-weight: 400;\"> (around 24,000 euros) from abroad, to register and publicly label themselves as &#8220;foreign funded\u201d, disclosing donors.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The law disproportionately affected CSOs critical of the state and triggered infringement proceedings from the European Commission.\u00a0In 2020, the Court of Justice of the European Union (CJEU) ruled that<\/span><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:62018CJ0078#page9\"> <span style=\"font-weight: 400;\">LexNGO 2017 breached European Union (EU) law<\/span><\/a><span style=\"font-weight: 400;\"> on two grounds. It violated the free movement of capital under <\/span><a href=\"https:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=CELEX:12008E063:en:HTML\"><span style=\"font-weight: 400;\">Article 63 TFEU<\/span><\/a><span style=\"font-weight: 400;\"> by deterring cross-boarder donations, and it infringed upon the rights of <\/span><a href=\"https:\/\/fra.europa.eu\/en\/eu-charter\/article\/12-freedom-assembly-and-association\"><span style=\"font-weight: 400;\">freedom of association<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/fra.europa.eu\/en\/eu-charter\/article\/7-respect-private-and-family-life\"><span style=\"font-weight: 400;\">private life<\/span><\/a><span style=\"font-weight: 400;\">, by imposing undue interference on the operation of independent organisations.\u00a0The court recognised transparency as a legitimate justification but found Hungary\u2019s measures neither necessary nor proportionate. The CJEU called for the laws repeal.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hungary repealed the law after a year\u2019s delay but replaced it with <\/span><a href=\"https:\/\/helsinki.hu\/en\/wp-content\/uploads\/sites\/2\/2022\/05\/HHC_LexNGO2021_info_note.pdf\"><span style=\"font-weight: 400;\">LexNGO 2021<\/span><\/a><span style=\"font-weight: 400;\">. LexNGO 2021 empowers the State Audit Office to inspect NGOs with annual budgets exceeding HUF 20 million (around 53000 euros). Despite being rebranded, it is operationally similar to its predecessor, drawing <\/span><a href=\"https:\/\/www.amnesty.org\/ar\/wp-content\/uploads\/2021\/08\/EUR2745262021ENGLISH.pdf\"><span style=\"font-weight: 400;\">similar criticism<\/span><\/a><span style=\"font-weight: 400;\"> for discriminatory application and potential breaches of EU law. LexNGO 2021 remains in force despite ongoing constitutional complaints.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The same tactic followed the <\/span><a href=\"https:\/\/civilizacio.net\/en\/news-blog\/five-years-anniversary-stop-soros?utm_source=chatgpt.com\"><span style=\"font-weight: 400;\">Stop Soros<\/span><\/a><span style=\"font-weight: 400;\"> legislation, which criminalised assistance to asylum seekers. The CJEU found it <\/span><a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=49797E50191FA481147E745A75688E6C?text=&amp;docid=249322&amp;pageIndex=0&amp;doclang=EN&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=1457492\"><span style=\"font-weight: 400;\">incompatible with EU law<\/span><\/a><span style=\"font-weight: 400;\">, but Hungary made only minor changes and left the core provisions in place.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In both cases, the Hungarian government has delayed, rebranded, or diluted the laws \u2013 but never fully complied with the CJEU, undermining the authority of the European legal order.<\/span><\/p>\n<h2><b>Escalation: \u2018Operation Starve and Strangle\u2019<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In 2023, the government went further. <\/span><a href=\"https:\/\/helsinki.hu\/en\/wp-content\/uploads\/sites\/2\/2024\/02\/Sovereignty_Protection_Act_breaches_EU_law_2024.pdf\"><span style=\"font-weight: 400;\">The Act on the Protection of National Sovereignty<\/span><\/a><span style=\"font-weight: 400;\"> established an investigative body with sweeping powers and criminalised the use of foreign funds for political purposes.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Then, earlier this year, Fidesz proposed the new <\/span><a href=\"https:\/\/helsinki.hu\/en\/wp-content\/uploads\/sites\/2\/2025\/05\/Bill-T11923_Transparency-of-Public-Life.pdf\"><span style=\"font-weight: 400;\">Act on Transparency and Public Life<\/span><\/a><span style=\"font-weight: 400;\">, widely seen as the most aggressive attack on independent civil society yet. At the heart of the <\/span><a href=\"https:\/\/www.amnesty.hu\/wp-content\/uploads\/2025\/05\/Operation-Starve-and-Strangle-2025-1.pdf\"><span style=\"font-weight: 400;\">proposal<\/span><\/a><span style=\"font-weight: 400;\"> is a discretionary power granted to the Sovereignty Protection Office (SPO) to list any organisation as \u201cunder foreign influence\u201d. If an organisation is listed:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It will be prohibited from receiving foreign funding, unless approved by the Tax Office in an unregulated and unknown procedure.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It becomes ineligible for 1% tax donations from Hungarian citizens.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Donors must provide the origin of their contributions.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Noncompliance may result in severe fines or forced dissolution.\u00a0<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Although the bill applies to any legal entity, government officials and SPO materials have made it clear the targets include watchdogs, journalists, independent media, and CSOs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although the vote has been delayed, the bill remains active, and the threat is real.<\/span><\/p>\n<h2><b>The Chilling Effect\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Although these <\/span><a href=\"https:\/\/www.amnesty.org\/es\/wp-content\/uploads\/2021\/05\/EUR2739682021ENGLISH.pdf?utm_\"><span style=\"font-weight: 400;\">laws seldom trigger legal action<\/span><\/a><span style=\"font-weight: 400;\">, their power lies in their chilling effect. The threat of being listed, audited, or stigmatised discourages cooperation and activity. Schools shy away from engaging with stigmatised NGOs. Services are rejected out of fear of retaliation from the administration. And state resources now flow to government-organised NGOs (GONGOs) as independent voices are starved.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If enacted, the proposed Act on Transparency and Public Life would have far more <\/span><a href=\"https:\/\/helsinki.hu\/en\/wp-content\/uploads\/sites\/2\/2025\/05\/Operation-Starve-and-Strangle-2025.pdf\"><span style=\"font-weight: 400;\">severe consequences<\/span><\/a><span style=\"font-weight: 400;\">. Opaque procedures that offer no meaningful legal remedy could allow authorities to block listed organisation from receiving foreign funding and accessing domestic revenue. The bill would strangle their operational ability and could lead to bans or forced dissolution.\u00a0<\/span><\/p>\n<h2><b>Strategies of Resilience\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Despite the pressure, civil society in Hungary has adapted.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While international legal victories for civil society have\u00a0 <\/span><a href=\"https:\/\/civicspacewatch.eu\/the-power-of-coalitions\/\"><span style=\"font-weight: 400;\">been important<\/span><\/a><span style=\"font-weight: 400;\">, the broader system of European enforcement has failed to be an effective deterrent. Equally, domestic litigation has offered minimal recourse as <\/span><a href=\"https:\/\/freedomhouse.org\/country\/hungary\"><span style=\"font-weight: 400;\">Lack of judicial independence<\/span><\/a><span style=\"font-weight: 400;\"> prevents structural change, as displayed <\/span><a href=\"https:\/\/www.liberties.eu\/en\/stories\/stop-soros-hungarian-constitutional-court-abandons-civil-society-organizations\/16856\"><span style=\"font-weight: 400;\">in the Amnesty case against the Stop Soros law<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under an administration with unchecked domestic power, legal ingenuity, and an incentive to restrict the civic space, litigation must be one element of a wider defence strategy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Stef\u00e1nia Kapronczay, former co-director of the Hungarian Civil Liberties Union (HCLU), explained in our interview, their organisational response. The HCLU boycotted LexNGO 2017, publicly challenging unconstitutional legislation they found \u201cso blatantly unlawful for violating human rights\u201d. When smear campaigns followed, they used the publicity to reaffirm their core values, turning attacks into opportunities for strategic messaging.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Funding diversification also became a strategic priority &#8211; not just to reduce dependence on foreign funding, but to strengthen legitimacy through the support of Hungarian citizens whom the HCLU defends.\u00a0To build public trust, the HCLU exceeded government transparency regulations, and published comprehensible financial graphs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThere is no better argument than pointing to the 6000 Hungarians who support us with their money\u201d Stef\u00e1nia Kapronczay explained, when responding to claims that the HCLU does not stand for Hungarian interests.\u00a0<\/span><\/p>\n<h2><b>Coalition as Defence\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Equally important to preserving financial independence is establishing unity.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In an environment designed to isolate and divide, Stef\u00e1nia explained that while \u201cIt\u2019s human nature to turn inwards\u2026 it\u2019s a trap\u201d. Responding with unity is critical as the crackdown can create openings for unexpected alliances. The external pressure can align youth, environmental, community, and human rights organisations \u2013 around common aims.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, <\/span><a href=\"https:\/\/civilizacio.net\/en\/home\"><span style=\"font-weight: 400;\">Civili\u017aaci\u00f3<\/span><\/a><span style=\"font-weight: 400;\">, a coalition of 30 core organisations, and over 300 affiliates, now plays a key role in coordinating responses and defending space for independent civic action.\u00a0<\/span><\/p>\n<h2><b>A Moment of Resistance<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">These strategies were essential when combatting \u2018Operation Starve and Strangle\u2019.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Over 325 organisations submitted an <\/span><a href=\"https:\/\/www.amnesty.eu\/wp-content\/uploads\/2025\/05\/OPEN-LETTER-ON-THE-HUNGARIAN-BILL-.pdf\"><span style=\"font-weight: 400;\">open letter<\/span><\/a><span style=\"font-weight: 400;\"> to the EU and the Council of Europe\u2019s Commissioner for Human Rights urged Hungarian lawmakers to<\/span><a href=\"https:\/\/www.reuters.com\/business\/media-telecom\/hungary-postpones-vote-law-that-could-curb-foreign-funded-groups-2025-06-04\/\"><span style=\"font-weight: 400;\"> reject the bill<\/span><\/a><span style=\"font-weight: 400;\">. Citizens mobilised to<\/span><a href=\"https:\/\/www.theguardian.com\/world\/2025\/jun\/04\/hungary-postpones-vote-law-curb-foreign-funded-organisations\"><span style=\"font-weight: 400;\"> protest<\/span><\/a><span style=\"font-weight: 400;\"> the bill in silence with their mouths taped shut to symbolise the silencing of civil society.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The delay marked a considerable success for civil society, but the risk of escalation still remains.<\/span><\/p>\n<h2><b>Hungary as a Warning<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Hungary\u2019s case serves as a warning.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The closure of civic space is not limited to authoritarian contexts. It is a global trend that is appearing in once-consolidated democracies.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Like the frog in boiling water, civic space does not collapse overnight. It shrinks slowly through legal changes, financial pressure, and political stigmatisation, until the threat is existential.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Civil society must recognise the early warning sings: rhetoric of transparency and national sovereignty, legal ambiguity, rising administrative demands, and restrictions on funding.
