{"id":94551,"date":"2026-01-13T08:37:04","date_gmt":"2026-01-13T13:37:04","guid":{"rendered":"https:\/\/www.dejusticia.org\/?p=94551"},"modified":"2026-01-13T13:23:07","modified_gmt":"2026-01-13T18:23:07","slug":"children-defenders-of-human-rights","status":"publish","type":"post","link":"https:\/\/develop.dejusticia.org\/en\/children-defenders-of-human-rights\/","title":{"rendered":"Children defenders of human rights"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">In 1975, the demonstrations for <\/span><a href=\"https:\/\/www.cultura.gob.ar\/noche-de-los-lapices-9503\/\"><span style=\"font-weight: 400;\">student bus passes in Argentina<\/span><\/a><span style=\"font-weight: 400;\"> were led by secondary school students between the ages of 13 and 18, who were later detained, tortured, and disappeared by the dictatorship. Almost fifty years later, <\/span><a href=\"https:\/\/www.scielo.br\/j\/er\/a\/F85DzgLpNc3XnQQ3s7KzS9G\/?lang=es\"><span style=\"font-weight: 400;\">in Chile<\/span><\/a><span style=\"font-weight: 400;\">, secondary school children began protests that would lead to a proposal to change the 1980 Constitution, which had been in force since the military dictatorship. Today, adults continue to debate whether children have the right to defend rights, while every day, children are exposed to invisibility, stigmatization, and violence for demanding and claiming their fundamental rights.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Defending rights is not only a right, but also a duty of all people, including children. In fact, the defense of human rights is one of the most important ways in which children can participate and be taken into account in the democratic system. In this sense, activism from childhood is an essential expression of democracy and, equally, of the protection of children.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Recently, the Constitutional Court of Colombia recognized for the first time that children have the right to defend rights. In analyzing the case of Rub\u00e9n, a 14-year-old child rights defender who faced a discriminatory and violent education system against LGBTIQ+ people, it took an important step toward recognizing the agency that children have and thus ensuring that they can exercise their rights. Below, we will explain what the right to defend rights means for children, as well as its limits and scope. To do so, we will present Rub\u00e9n&#8217;s case and the court&#8217;s recognition of his work as a human rights defender. Finally, we will analyze some of the challenges and obstacles that remain to be overcome so that children can exercise their rights and their right to defend them.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><b>Rub\u00e9n, the child human rights defender<\/b><\/p>\n<p><b>\u00a0<\/b><span style=\"font-weight: 400;\">Rub\u00e9n is a 14-year-old human rights defender who was punished by his school in retaliation for reporting the violation of the rights of LGBTIQ+ students at the educational institution. In 2023, the student reported in a video on social media that his school punished practices it considered &#8220;homosexual&#8221; and showed a documentary in sex education classes that encouraged the use of so-called <\/span><a href=\"https:\/\/www.ohchr.org\/es\/stories\/2020\/07\/conversion-therapy-can-amount-torture-and-should-be-banned-says-un-expert\"><span style=\"font-weight: 400;\">&#8220;conversion therapies<\/span><\/a><span style=\"font-weight: 400;\">,<\/span><a href=\"https:\/\/www.ohchr.org\/es\/stories\/2020\/07\/conversion-therapy-can-amount-torture-and-should-be-banned-says-un-expert\"><span style=\"font-weight: 400;\">&#8220;<\/span><\/a><span style=\"font-weight: 400;\"> i.e., interventions to change the sexual orientation of LGBTIQ+ people. He also warned that the institution had expelled two LGBTIQ+ classmates for displays of affection within the school.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">In retaliation for the complaint, the school canceled Rub\u00e9n&#8217;s enrollment, considering that the student was spreading defamatory discourse about the educational community. When Rub\u00e9n went to court, the institution reinstated him in a &#8220;semi-schooled&#8221; modality, preventing him from participating in classes in person and sharing with the educational community. In addition, it made his continued enrollment conditional on his apologizing and removing the video of his complaint.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><b>Recognizing the right of children to defend rights\u00a0<\/b><\/p>\n<p><b>\u00a0<\/b><span style=\"font-weight: 400;\">At Dejusticia, we presented an innovative approach to the case: the right of Colombian children to defend rights. Children are entitled to a series of rights, such as freedom of expression, the right to express their opinions, the right to be taken into account, and the right to education. Taken together, these rights form the basis of the right to defend rights. For children, this right implies the duty of both the State and educational institutions to instill respect for and defense of human rights, but also to empower those who wish to exercise their defense. It also implies the adoption of effective actions to eliminate all types of discrimination and stigmatization that arise against this work. In other words, schools must be an enabling place for the promotion of human rights, ensuring that children exercise their rights and, consequently, fostering a safe, inclusive, and discrimination-free educational environment. Ensuring that children and adolescents can know, monitor, and demand the fulfillment of their fundamental rights and freedoms is essential to ensuring that all their rights are respected and protected.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">This argument was set out in Constitutional Court <\/span><a href=\"https:\/\/www.corteconstitucional.gov.co\/relatoria\/2024\/t-529-24\"><span style=\"font-weight: 400;\">ruling T-529 of 2024<\/span><\/a><span style=\"font-weight: 400;\">, which determined for the first time that children have the right and duty to defend human rights and, as such, enjoy special constitutional protection. For the Court, the work of children as human rights defenders fosters the construction of a democratic and tolerant society that promotes peaceful coexistence. In this sense, educational contexts are essential settings in which students must begin to understand and exercise their rights and duties, which is one of the main objectives of education in constitutional states. To this end, they must have the right to exercise this defense and be protected by the state in their work.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">The high court concluded that the educational institution used its disciplinary power as a tool to silence the voice of a human rights defender. In fact, the Chamber considered that messages denouncing discriminatory situations in the educational environment fulfill a constitutionally protected democratic function. Therefore, it considered that the entity&#8217;s sanction constituted an act of censorship that violated the student&#8217;s rights.\u00a0<\/span><\/p>\n<hr \/>\n<h3><strong>Read another article from the latest edition of El Sur Global: <a href=\"https:\/\/develop.dejusticia.org\/en\/litigating-also-means-imagining-possible-futures\/\">Litigating also means imagining possible futures<\/a><\/strong><\/h3>\n<hr \/>\n<h3><b>\u00a0<\/b><b>Recognizing children&#8217;s agency helps facilitate the defense of human rights\u00a0<\/b><\/h3>\n<p><b>\u00a0<\/b><span style=\"font-weight: 400;\">The Constitutional Court&#8217;s ruling is a first step at both the national and international levels toward protecting the defense of children&#8217;s rights. In line with the <\/span><a href=\"https:\/\/docs.un.org\/es\/A\/HRC\/55\/50\"><span style=\"font-weight: 400;\">pronouncements of United Nations agencies<\/span><\/a><span style=\"font-weight: 400;\">, the ruling in Rub\u00e9n&#8217;s case provides us with some basic elements for advancing the elimination of the obstacles that children face in exercising their right to defend rights. Indeed, for this right to be effective, beyond its recognition, children need spaces, such as educational environments, where human rights are actively taught and instilled, but also where their defense is promoted and those who defend them are protected.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">While the Court&#8217;s ruling represents a significant step forward, there is still work to be done. For the decision to truly transform the lives of children, concrete orders are needed that are directed at state institutions, and especially the education system, to guarantee their right to be human rights defenders. Without these measures, the impact of the ruling on the lives of children will be limited. Additionally, it is necessary to combat the adult-centric view that reduces children to subjects who require special protection, but who are unaware of their capacities, their agency, and their active exercise of rights. This approach, although based on the best interests of children, can lead to silencing their voices, denying them autonomy, or minimizing their participation in social and political life. Recognizing that children require special protection should not be incompatible with recognizing that they also have the capacity to act, express their opinions, and defend their rights.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">As long as their agency remains invisible, children&#8217;s activism will be discouraged, ignored, or even punished. Ignoring that children have the right to express themselves, to voice their opinions, and to act places them in a greater situation of vulnerability. Children who do not know their rights, who do not know that they have the right to defend them, or who are silenced when they do so, do not have the tools to protect themselves. Children who cannot defend their rights are condemned to live with violence in silence.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Constitutional Court of Colombia
